Hi girls, so I’m booking my op date next week and spoke with my manager today to let him know that I’ll be taking 2 weeks holiday and then on light duties for the next 4 weeks and there will always be another staff member to help with heavier duties. The response I got was if I get the op and don’t come back after the 2 weeks 100% fit for work (able to carry out the heavier duties) then I’ll lose my job, he then went on to say I’m just in a rush to get them done before summer to show them off in a bikini, and that there are another 6 months of the year when I can get it done and he told me I should go away and research it more! I was so shocked he’d said this I’ve wanted this for years and it’s just convenient for me to get it done at this time due to funds and holidays! I’m just wondering what my rights are and whether anyone has experienced the same problems with work? He won’t give me a number for our HR so not sure what to do to get advice, I’ve worked there 3 years now so thought he would have been more understanding and let me do light duties for the 4 weeks I’ll be back while I’m recovering still! What do you do? Is there another way you can get the nunber for HR? If you go back after 2 weeks with a note from your GP advising light duties only then there’s nothing he can do, you can’t be sacked! And if he tries to sack you, you’d have grounds for unfair dismissal and I’d say some sort of discrimination too! x
Yes what Gemma said get a letter from your GP. And to be honest, i dont know of you would say this to him or not but I would tell my boss that its none of his business! Just say ok to him then come back with a letter from your doctor. He should’nt be saying any of this to you!! X

It might be worth speaking to citizens advice if you can’t speak to someone in HR on Monday, they usually have someone who’s experienced in employment law at each centre and give you more of an idea of rights but I’m pretty sure it would be grounds for unfair dismissal if he did try to fire you.
I’d definitely make a record of everything that’s been said so far with regards to discrimination and ask for someone else to be in the room so you have a witness of further conversations too. X
I’m a supervisor in retail but it’s quite a high end brand so the manager is really up tight with things like this! I think I might call citezens advice on Monday to find out what rights I have, and I’ve alreasy been documenting everything he’s said about it that’s been unprofessional because it’s non of his business and he doesn’t know my reasons! He’s also told another member of staff about what I’ve spoken to him about which I know he can’t do so going to try get the number for Hr and report it and see what I can do, thanks!xx

Ah I’ve just seen above…. 3 years. You’ve worked over 2 years so that’s a good thing. So firstly he has to approve your annual leave, that will be his decision as your manager to allow the annual leave or not. By the sounds of it he has already accepted it. Regardless if the op if for medical or cosmetic reasons he has a duty of care for you health and safety in the workplace, therefore if you tell him you cannot lift etc he should find alternative. I would put your concerns in an email to him, so you have proof of future conversations with him. He shouldn’t be sacking you for TEMPORARILY not being able to carry out full duties. If he does you have written conversations as proof and you would probably have a good case to go employment tribunal for unfair dismissal. I would also call ACAS (not citizens advise) just to go over it all, they will advise you what’s the best approach going forward with you employer and they will advise you of their legal responsibilities so you have that to go him with. As he isn’t working in HR he probably doesn’t even know he has these responsibilities and will change his tune if you mention this. Hope this helps xx

It’s only a job to earn extra money while I’m at uni but I really didn’t want to have to leave any earlier than I had planned! He sounds like a right knob! You should always have access to your hr department be that by being able to go and see them or a contact number, don’t let him spoil something you should be looking forward to 🙂 xx
Acas are so helpful with these kind of dick ish situations. Theyve helped me twice & my work place have shit themselves twice and changed their minds, and done thing right thing in the end. Its not right you should have to go to all the trouble of seeking advice but its worth it xx
Hiya, I have also had trouble with work and getting the time off, We are not allowed to have more then 2 work weeks off but i was asking for 112 working days and I got told No. When i said it has been allowed in another team fr a holiday and mine is surgery recovery which i think is bit more of a reason to have it off. I got told No and especially because of what the procedure is it would look like im being favored because i work with alot of men !!
@princesssascha that’s like my work I’m not allowed more than 2 weeks off at a time so I’m going to take between 7&10 days depending how many days holiday I have left! And that’s so bad it shouldn’t matter what procedure you’re having or the reason you’re having the time off! My work place is mainly males too there’s only one other women who I work with I’m just going to hope no one else notices and I’m just going to say I’ve ahd a shoulder operation or something if they ask why I’m taking it easy xx
